Maryland's Phase II Watershed Implementation Plan (October 2012)

Overview

During 2011-2012, Maryland worked with local teams to develop a Phase II Watershed Implementation Plan (WIP) for the Chesapeake Bay. This web page provides information that supports that plan development process.

What's a Phase II WIP? 

The Phase II Watershed Implementation Plan (WIP) is part of a 3-phased planning process to achieve nutrient and sediment clean-up goals for the Chesapeake Bay.  This initiative is important because it will create the road map and accountability framework that steer us toward clean local streams a healthy Chesapeake Bay.

During 2010 the U.S. Environmental Protection Agency (EPA) set limits on the amount of nutrients and sediments that can enter the Chesapeake Bay.  In addition to setting these limits, known as Total Maximum Daily Loads (TMDLs), EPA required the Bay states to developed statewide "Phase I" WIPs.  The Phase I WIP allocates the allowable load among different sources and identifies statewide strategies for reducing nutrients and sediments that impair the Chesapeake Bay. The Executive Summary of Maryland's Phase I WIP further explains the rationale for the plan.

The Phase II WIP refined the Phase I plan to include more local details about where and how nutrient and sediment loads will be reduced to clean up the Bay. Although the Phase II WIP is a State document, required by EPA, Maryland is strongly encouraging local partners to participate in developing the plan during 2011.

 

How will Maryland Develop the Phase II WIP?

During 2011, the State worked with local teams to develop the Phase II WIP.  The local teams, organized at the county scale, will include representation of entities with responsibility and authority to control nutrient and sediment loads like county and municipal governments, soil conservation districts, federal and State agencies among others.

State staff served as "liaisons" to the local teams and lead them through a systematic series of steps to formulate the key elements of the plan.  The elements of the plan and guidance materials for the development process are provided below.

What are the Key Elements of the Phase II WIP?

The following is a brief summary of the key parts of the Phase II WIP.  These are described further in the Guidance Binder materials below.

  • Target Loads: The Phase I WIP included "Final Target Loads," predicted to meet water quality standards, that are to be achieved by 2020.  "Interim Target Loads" that meet 70% of the Final Targets are to be achieved by 2017. Because the EPA's watershed model will be revised as part of the Phase II process, these target loads are expected to change somewhat. Because it was determined that meeting the 70% by 2020 was unachievable within the given timeframe, Phase II WIP will have the goals of meeting 60% of the Final target by 2025.

In addition to this overall shift, the Phase II WIP will further divide the Interim and Final Target Loads among a) smaller geographic areas and b) types of sources, like waste water treatment plants, urban stormwater, septic systems and various agricultural sources. It will also identify a set of specific actions that are capable of achieving the reductions necessary to meet the Interim Target by 2017. The intent is to provide goals at a local scale so that the shared responsibility is clearer to everyone.

  • Current Capacity Analysis: The Phase II WIP will help determine how much the Interim Target, of 60% of the 2025 Final Target, we can achieve by 2017 with current resources. The Current Capacity Analysis will identify the gap between what we can achieve with our current capacity and what Maryland needs to achieve. The analysis should account for future growth in loads and will help us better understand our resource limitations and needs.  EPA guidance prompts a broad view of "capacity" by considering legal, regulatory, staffing, financial, technical and programmatic capacity. This can be accomplished by including these considerations as part of describing our key programs. These analyses will support the development of strategies and 2-Year Milestones outlined below.
  • Strategies to Achieve Interim Targets:  The Phase II WIP will include commitments to strategies for achieving needed pollution reductions. The strategies will build upon the capacity analyses and program descriptions noted above. The plan will also include specific controls, technologies, and practices that we commit to implementing by 2017 to meet the Interim Target Loads.  As needed, the plan will describe enhancements to policies, programs, authorities and regulations needed to increase our capacity.  For each strategy, the plan will include a schedule by which key steps will be taken, including capacity-enhancement steps.
  • Contingency Strategies:  The Phase II WIP will include back-up options for those strategies that are delayed or cannot be implemented for some reason. 
  • Tracking & Reporting:  The Phase II WIP will include descriptions of local procedures, currently underway or planned, for tracking and reporting the kinds of implementation addressed by the strategies. 
  • 2-Year Milestone Commitments for 2012-2013:  Although not formally part of the Phase II WIP, the State will be working closely with local partners to develop near-term implementation and program development goals by November 1, 2011.

Informational Meetings on the Phase II WIP

Regional Kickoff Workshops:  During January and February 2011 Maryland hosted five regional workshops with the assistance of the Hughes Center for AgroEcology, with funding support from the Chesapeake Bay Trust and the Town Creek Foundation. The day-long meetings introduced participants to general background, the Phase II WIP process during the morning sessions.  During the afternoon State liaisons initiated a process of establishing local teams that will work as partners with the State to develop the Phase II WIP.
