General Permit For Stormwater Discharges Associated With Industrial Activity
The Maryland Department of the Environment has reissued the State/National Pollution Discharge Elimination System (NPDES) General Permit for Stormwater Discharges Associated With Industrial Activity, Permit No. 12-SW (NPDES No. MDR00). The permit is now issued as final with an effective date of January 1, 2014. This permit replaces Permit No. 02-SW.
There was a typographical error in other publications regarding judicial review. Any petition for judicial review must be filed in accordance with §1-605 of the Environment Article no later than December 2, 2013 (not 2014), and must be filed in a circuit court in Maryland.
The restoration requirements in the final permit apply to any permittee whose facility is 5 acres or greater in size and is located within the Chesapeake Bay Watershed within a Phase I or Phase II Municipal Separate Storm Sewer System (MS4) jurisdiction. The permit requires restoration, where applicable, to be completed by the end of the 5-year permit term for renewals, or four years for new registrations. The restoration plan is required to be incorporated as part of the required Stormwater Pollution Prevention Plan (SWPPP).

Renewal applications for coverage must include a completed and signed notice of intent (NOI), fee payment, and updated Stormwater Pollution Prevention Plan (SWPPP) submitted to the Department no later than:
- June 30, 2014 for existing permitted facilities not subject to Chesapeake Bay Restoration Requirements (Part III.A of the Permit) or
- December 31, 2014 for existing permitted facilites subject to Chesapeake Bay Restoration Requirements (Part III.A of the Permit)
